The honest version
In India, a Prenup is Not Strictly Enforceable. But It Still Does Real Work.
The Hindu Marriage Act and the Special Marriage Act do not expressly recognise prenuptial contracts. So a prenup in India is not binding the way it is in many Western jurisdictions. (Goa is the exception. The Portuguese Civil Code there does treat prenups as enforceable.)
That said, a well-drafted prenup is far from useless. It functions as a written memorandum of intent. If divorce ever happens, courts treat it as strong evidence of what each party agreed to. It often becomes the basis of the settlement memorandum (MoU) in a §13B mutual-consent filing. And maybe most importantly, it forces the conversation now, when you are aligned, rather than later, when you are not.
Think of it as a private agreement that helps a public process if it ever has to happen.

A note on enforceability
We are Honest About What a Prenup Cannot Do.
A prenup in India is treated by courts as a contract under the Indian Contract Act 1872. It is not given the special enforceability that some Western jurisdictions provide. A court can, and does, set aside terms that are unfair, against public policy, or signed under duress.
That is a feature, not a flaw. It means a partner cannot be locked into terms that genuinely harm them. It also means a fair, mutually-drafted prenup signed in good faith is treated very seriously by courts. An unfair, lopsided one usually is not.
